Na decisão, o magistrado considerou que o bloqueio da conta foi indevido, uma vez que a instituição financeira não apontou qual o real motivo do bloqueio e o manteve por longos meses.

Ademais, o juiz registrou que a instituição financeira não apresentou solução da questão em tempo adequado, “caracterizado, portanto, deficiência na prestação de serviços, consequentemente, a responsabilidade objetiva”.

Nesse sentido, o juiz registrou que existiu, sim, o dano moral suportado pelo autor quando da impossibilidade de utilizar o saldo existente para pagamento de suas contas regulares.

“Ante o exposto, ACOLHO o pedido formulado na inicial para, confirmando a tutela antecipada anteriormente deferida, CONDENAR a ré na obrigação de fazer consistente em restabelecer os serviços bancários até que o autor possa retirar o saldo existente, ressalvado o direito de rescisão unilateral, após a devida notificação, bem como CONDENAR a requerida ao pagamento de R$ 4.000,00 à título de indenização por danos morais (…)”
